Terms of Service

Please read these terms carefully before using our services

Welcome to Bright Folio Art Education. These Terms of Service ("Terms") govern your use of our website, courses, and services. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By enrolling in our courses, using our website, or accessing our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

2. Description of Services

Bright Folio Art Education provides:

  • In-person art education courses and workshops
  • Educational resources and materials
  • Online content including blog articles and newsletters
  • Private instruction services
  • Art-related events and exhibitions

3. Eligibility

To use our services, you must:

  • Be at least 18 years old, or have parental consent if under 18
  • Provide accurate and complete information during registration
  • Maintain the confidentiality of your account information
  • Comply with all applicable laws and regulations

4. Course Enrollment and Payment

4.1 Enrollment

Course enrollment is confirmed upon receipt of full payment unless payment plan arrangements have been made. Class sizes are limited, and enrollment is on a first-come, first-served basis.

4.2 Payment Terms

  • Payment is due in full at the time of enrollment unless otherwise arranged
  • We accept major credit cards and bank transfers
  • All prices are in Canadian dollars (CAD) unless otherwise specified
  • Prices are subject to change but will not affect confirmed enrollments

4.3 Payment Plans

Payment plans may be available for certain courses. Late payment fees may apply for overdue installments. Failure to make payments may result in course suspension.

5. Cancellation and Refund Policy

5.1 Student Cancellations

  • More than 7 days before course start: Full refund minus $50 CAD administrative fee
  • 3-7 days before course start: 50% refund
  • Less than 3 days or after course start: No refund
  • Medical emergencies: Considered on a case-by-case basis with documentation

5.2 Bright Folio Cancellations

We reserve the right to cancel courses due to insufficient enrollment or unforeseen circumstances. In such cases, students will receive a full refund or the option to transfer to another course.

6. Attendance and Make-Up Policy

  • Regular attendance is expected and essential for course completion
  • Students may make up missed classes by attending the same session in another course cycle
  • Make-up arrangements must be made in advance when possible
  • Excessive absences may affect course completion certification

7. Code of Conduct

All students are expected to:

  • Treat instructors and fellow students with respect
  • Arrive on time and prepared for classes
  • Maintain a positive and supportive learning environment
  • Respect studio equipment and materials
  • Follow safety guidelines and instructions
  • Refrain from disruptive behavior

Violation of the code of conduct may result in course dismissal without refund.

8. Intellectual Property

8.1 Our Content

All course materials, website content, and instructional resources are the intellectual property of Bright Folio Art Education and are protected by copyright laws. Students may not reproduce, distribute, or sell our materials without written permission.

8.2 Student Artwork

Students retain ownership of artwork created during courses. However, by enrolling, students grant Bright Folio the right to photograph and use images of artwork for promotional purposes unless specifically opted out.

9. Liability and Disclaimers

9.1 Limitation of Liability

Bright Folio Art Education's liability is limited to the amount paid for services. We are not liable for indirect, incidental, or consequential damages arising from the use of our services.

9.2 Health and Safety

Students participate in activities at their own risk. We maintain appropriate safety measures, but students are responsible for following safety instructions and disclosing any health conditions that may affect participation.

9.3 Personal Property

We are not responsible for loss, theft, or damage to personal property brought to our premises.

10. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

11. Website Use

11.1 Permitted Use

You may use our website for personal, educational, and informational purposes. Commercial use requires written permission.

11.2 Prohibited Activities

You may not:

  • Use the website for illegal purposes
  • Attempt to gain unauthorized access to our systems
  • Distribute malware or harmful code
  • Scrape or copy content without permission
  • Interfere with website functionality

12. Communications

By providing your contact information, you consent to receive communications from us regarding your courses, our services, and promotional materials. You may opt out of marketing communications at any time.

13. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our control, including but not limited to natural disasters, government actions, pandemics, or other emergencies.

14. Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified Terms.

15. Termination

We may terminate or suspend access to our services at any time for violation of these Terms or for any other reason at our sole discretion.

16. Governing Law

These Terms are governed by the laws of Ontario, Canada. Any disputes will be resolved in the courts of Ontario.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bright Folio Art Education regarding the use of our services.
